Technically no she won't. Government has to be seated for that to happen. All 435 members of the House are up for reelection. They are seated on January 3rd. You can't seat government if there is no election as you have to have a quorum to do so. It would go to the Chairman of the Joint Chiefs of Staff (Mark A. Milley) and then provided the Senate has a quorum of 50 members they would pick the VP. Provided Marital Law wasn't declared. The Governor's could seat the House and Senate without a vote. Presently there are 27 Republican Governor's and 23 Democratic Governor's with 11 open for election. Governor's take office January 1. So if that were the case you would have 31 Republican Governor's and 19 Democratic Governor's and the Republican's would control both houses in theory. In that case if Trump were to leave office on the 20th after all that. Most likely Kevin Mccarthy would become President and the Senate would then pick the VP.
