The Gilead's of the world ( actually all pharma companies) are attempting to circumnavigate the wildly bloated federal bureaucracy at the FDA. It is the reason it takes so long for trials; the company creates false/misleading hand picked patients and data in order to skew the stats and the FDA must sift thru and parse every single detail in order to catch them cheating. Add lobby money to the mix and we have perfect storm of a dog chasing it's tail.
The people at the FDA are not evil, they are just pigs at the trough of the public feeder with little or no incentive to speed the process of their day to day dealing with bullshit data from companies trying to game the system in most cases.
If I had to assign evil it would be on the vast majority of pharma, and probably tilted to the public ones.
