What happened was as follows:
- Shasta made a generic version of a JnJ test strip. DECN marketed it.
- JnJ sued for patent infringement.
- Shasta admitted infringement. DECN contested it.
- After several legal rounds the JnJ patents were tossed. DECN won. A modest settlement was agreed.
- This cleared the field for people to make and sell low cost smbg test strips.
- DECN spunked a portion of the modest settlement on 2 expired patents from Tall oaks ventured and sued JnJ with them, and the rest on the required legal representation to prosecute them.
- The price of test strips went though the floor after the patents had been over turned. Every new entrant except DECN made money on the back of this. DECN opened the field to all of its competitors. Most of whom were better at it when it came to building and selling smbg test strips.
- DECN hyped a $400m-700m settlement for the TOV patents, and scammed Investors n the back of this hype. But these patents were already dead ducks. That's why DECN were able to buy them. Because JnJ, Roche, bayer and dozens of others had already passed them up as valueless!
- DECN 'literal infringement' suit of the TOV patents fell at (or before) the first fence (Summary dismissal). Unsurpising if you did a cursory analysis and knew the first thing about the JnJ test system.
- But DECN were allowed to pursue a "Doctrine of equivalents" infringement claim against Jnj. The DOE infringement sets a much higher legal and evidential bar than literal infringement, which couns against DECN. Despite this, DECN management claimed this as 'an overwhelming victory' for the comapny.
- But unsurprisingly, the judge ruled against DECN in the DOE infringement claim after a 'request for summary judgement'.
- DECN appealed.
- DECN lost this appeal.
At which point DECN finally shut up about besting JnJ and $400-700m settlements. Complete radio silence in fact! No explanations. No excuses. Just ... silence!
- DECN makes noise about revolutionary "new" test strips - based on stuff that people in the business have known about, made, used and sold for years!
- DECN tries to pull a covid 19 detection scam.
- The end!
