craigakess: what you are missing is knowing what BP companies are offering. The BO of forty-seven at 4.9b by GILD strongly suggests to me (obviously, I don't have any personal info) that GILD would have gladly paid more than that for CYDY. But, my assumption is that the CYDY bod would not seriously entertain any offer in the 5b range. Hence, no serious negotiations. The biggest obstacle to settling a civil lawsuit is the difficulty that often arises in getting both sides to credibly assess the settlement value of the plaintiff's case. Here, it appears to me that the CYDY bod is assessing the value of Leronlimab much more credibly than BP bods, or BP bods know Leronlimab is worth several multiples of 5b, but still believe a bargain price is possible (at least prior to 2 grants of BTD).
