Jake2212: It doesn't have to be a material provision for it to be breached. A warranty is a warranty and if breached, they are not necessarily entitled to just rescind the contract, you have to know how the contract is worded. There may be very specific provisions as to how things are handled in the case of a breach. There is usually a notice and cure period, for one thing. And you have NO IDEA if monetary damages can be recovered or not. Again, one has to READ THE CONTRACT in order to speak on in intelligently.
