The end of Q3 was actually changed to become the end of the fiscal year (for Form 10 purposes). Here are the latest milestones announced (below). Unless otherwise announced, there is no reason to speculate that the CEO won't get all of items completed in the timeframe specified (late January to early February). Note that the shareholders meeting was actually pushed up. Why have it earlier than originally scheduled if the Form 10 wasn't going to be filed before as scheduled?
And the staleness issue is overblown. All they need to do is add Q1 to the last two fiscal years. It's simple math. Apply the 135-day aging rule and you will see that there is no issue with staleness.
