Our patents are good, they've just been ruled, several times, to cover a narrower range of IP than we had hoped.
It's not necessarily that they cover a narrower range of IP. It's that the courts (because of Alice 101) interpret OOBA as an "abstract idea" that already had existed outside of computer systems.
