I can’t speak from experience, but I’m sure a conditional deal can be announced by either company, but I’d assume that’s on a case to case basis.
NP said a while back that the lawyers had advised him that he couldn’t say much else regarding the deal. Both sides just have agreed to an NDA until the deal is officially announced, allowing NP to only release a few details.
