This morning, one posting on the Federal Circuit Web Site and a correction of a previous case posted. No Rule 36s. I would say that all of the October "knee-jerk" Rule 36s have occurred. Now the countdown begins for a ruling or change of mind. If a non-Precedential ruling I would guess you'll see it in 5 weeks, if a Precedential ruling 7 weeks. Just my opinion.

As to how $350 million turns into $25 million, take over the company and you can then oversee endless litigation against J&J, the opportunity with Platinum will disappear in the length of the endless litigation, and you can be the guy, along with Spidey, morally responsible for turning down a handsome settlement in exchange with more endless fighting with J&J. You will also be responsible, along with all of your other CEO duties, for putting together the litigation plan and approving the budget for little things like $500K in expert fees, depositions in Pennsylvania, New Jersey and Scotland. But hey those are just details.

Along the way you can, for the first time in your professional life, be involved in a highly complex litigation against a Fortune 25 that has $175 billion in the bank and actually expect to overwhelm them. It's really a simple task. The company is going to get that handsome settlement because J&J believes that KB is on the one hand fearless, and on the other hand crazy. These are two things that go hand in hand when shooting at ghosts. J&J does not know how to deal with crazy. Nobody does.
