Now as to why Mr. Berman will settle the case for $25 million -- if that is the number? I have no answer to what KB will do, but if I were faced with that decision, I would take $25 million in a New York Minute. Who cares what the real damages were. A jury might not agree with the company, the judge at the pre-trial conference may throw out, for whatever reasons, some of all of DECN's case. These things happen and those are the chances you take in litigation.

So in the months ahead, DECN has decisions to make knowing that the last place J&J wants to be these days is in a court of law in front of a jury. Does DECN accept an offer, do they reject an offer, do they counter the offer. Will there be an offer? Yes there probably will be -- several. Is DECN prepared to go to trial. It will cost about another million dollars to take the case to trial and I would guess about a year of Mr. Berman's time.

My father told me many years ago that when you are young you have two things going for you -- a lot of teeth and a lot of morals at play. I am sure Mr. Berman has lost teeth over the last 5 decades. He played competitive ice hockey for 2 decades. Has he lost his moral compass along the way? Many shareholders think so, without proof.

I personally feel that $25 million is a very good number. I think $15 million is a very good number. DECN will never see $350 million even with a jury verdict against the already court wounded J&J. Jury verdicts are either appealed, settled or both.

DECN should take the effing money. All IMO.
