Not in my opinion. People feel strongly about their positions on several topics. That is why they:
1. post the same (nonsense) daily, even multiple times each day
2. contact and complain to the SEC and FINRA about fake crimes
3. attempt to conjure up class action lawsuits against a company that has no money
All over the price of the stock as if Mr. Berman is actually going out of his way to keep the price down.
Now to the Federal Circuit case postings this morning. There was one Rule 36 and it was for an international trade case heard on October 10, the last day in October the court heard cases. I raise my confidence up to 98.46344%. Tomorrow marks the two week mark for panels who heard cases on October 3 and October 4. Although I am pretty sure the judges are done posting Rule 36s for October cases, which include hearings on September 30, I think we are clear of Rule 36 (after tomorrow) until January, when the panels will meet and confer on September 30 through October 4 cases. After Friday, if not accomplished already, judges will be assigned to write the majority and dissent opinions on each case. It may turn out that a couple of the October cases, on second thoughts, will generate a later Rule 36, but if I am J&J I would certainly not bet on it.
I figure, and I await Sensi's Friday post, that if the panel judges find in favor of DECN, which Sensi believes will be 2 votes in favor of DECN, one that is partially opposed and partially in favor (a split decision by one judge), that a favorable finding could cost J&J an added $100 million -- because as many people have missed here while either betting on an outcome or bashing Mr. Berman, J&J has already put on almost the entirety of their case, which in my opinions was a very dumb move but quite descriptive of J&J's utter arrogance. Sort of like a wild lefty walking a batter intentionally to load the bases, with the manager forgetting that the lefty also walked the two previous batters. J&J's strategy never made sense to me.
