This appeals court works differently than most courts. If the case gets blown out it means that the judges choose not to rule. It then defaults to the district court ruling.

I won't get into the legalities of the two sides, but I will say that jnj used their second chair to make the arguments. In my opinion he did not do a particularly good job.
