First of all this week will mark the third time DECN will be in front of the Federal Circuit court. The first time in 2013, I believe prior to your becoming a shareholder in DECN, the company as a defendant, won their first case in the Federal Circuit court, a Precedential ruling (new law) on what is known as "exhaustion." This sowed the seeds for two things that happened a little later, first in 2014-2015 (with two J&J appeals all the way to the Supreme Court) the loss of the J&J foundational patent which itself was the major cause of J&J selling off Lifescan because it left J&J open to suits from large competitors, or the potential loss of suits against these same competitors who sued J&J for infringement actions of their own (Abbott, Roche). And second, a cash settlement with J&J where they paid DECN who was the defendant, to end the case.
I know that you feel that any trained monkey can run DECN better. I also know that you detest Mr. Berman. You and J&J detest Mr. Berman for different reasons. J&J hates him because he was damn good. He beat them -- twice, and he will beat them again. He laid bare their $3 billion business which lead to J&J selling that division off. They paid him to stop. They paid a defendant and then granted DECN a license to their patents (what was left of them) into perpetuity.
So while you trash Mr. Berman on and on, with the knowledge that you or a trained monkey can do better, and blame him for all of the world's problems, just remember that J&J grants him grudging admiration. And they may be even more admiring of his tenacity after Wednesday, October 2.
He plans to settle the case against J&J. Will you continue to trash him for doing this --- you already started. Berman plans to close a licensing deal with Platinum and save their collective azzes. Platinum will admire him too. You, you'll sit on three message boards trashing him. All IMO.
