So market is doubting the financing or deal. My guess they have several possible and are waiting on responses from whoever to finish the deal. The share price isn't helping. Maybe they have the financing, maybe not, I don't know. If they don't, this is what I would do.
1) They have 100M shares. Sell some to get $20M cash to finish the BLA and pay off note holder, whatever the rate is without warrants, restricted 6 months. Say 30c, or whatever the rate they can get to big investors. It was a higher price Friday than today. So speed would be of the essence here. That frees up the 50M restricted for he note holder
2) We are relaying on the deal to be done after the BLA to the funding and market. That funding gets to BLA and assumes a deal must be done. Maybe the deal maker decides to wait for a better deal. I don't like being in the situation relaying on the deal, while sp declines, hurt your position in the negotiations. So over the next 3 months, you are funded to get BLA. Get R/S 15:1 approved, bring in help to talk about uplisting, there are firms that specialize in it. This is backup plan if no deal is reached. If you have read all my posts I have usually against that. In this case, sp at 32c, I am not concerned shorts could push it lower, especially with drug approval coming. Again that is the backup. Right now Q4 is do or die here, the market senses that, maybe the deal makers sense that.
Take control back by 1) having funding to BLA, (no more shares and warrant funding) 2) get rid of note holder 3) having backup options just in case, so the deal being done is not critical (which right now it is).
