Because the Supreme Court's Solicitor General was invited to file a brief in the HP v. Berkheimer case (which is also an Alice 101 case). That only happens if the Supreme Court shows interest in taking the case. That would be a revisit of Alice 101 and I don't think they would take a similar case just to uphold the previous Alice decision.
Also because Congress' draft Bill has no exception for "abstract ideas" which is why the Federal Court of Appeals upheld/affirmed the lower court ruling against Strikeforce Technologies.
...which means the odds are now in our favor either way.
