#3 unlikely imo. The board had the option to restore RP's power after he gave his intention to resign. To me looking at the tea leaves, I am guessing there was a power play with RP, Dockery, and Gould, possibly some other shareholders. NP found out told RP not to talk to anybody else. RP possibly even intentionally delaying items to hurt funding until after, maybe he even had other funding lined up with the ousting of NP.... Just an opinion based some posts here and reading the suit a couple times. We will see how the company responds. But if not that, there is definitely more to the story than what the lawsuit lays out.
Anyway, I believe they just raised 4.1M with both the direct and preferred options, my guess is #4 to get them to the BLA. I'm not sure if they need more, but I am guessing upfront payment deal comes after the BLA.
