We should probably be looking closely at upcoming events with Berkheimer SCT. Why? As it indicates in the filing: "Because our case and Berkheimer SCT present essentially the same issues, the Court should hold the petition in this case pending Berkheimer SCT and then dispose of it as appropriate in light of its decision in Berkheimer SCT."
