I think what he meant is those still bashing away

I think what he meant is those still bashing away at the company do not want a court precedent set that they willingly find in favor of the plaintiff, but do not allow any shares to transfer hand. Meaning if HJOE returns, those liabilities are still there and by court rule cannot get any further shares.
