When the lower court delivers it's record for review, SCOTUS will see a decision rendered based on Rule 36 (Bypass rule), without any definitive explanation as to how that decision was reached, as well as the reference to the original ruling based on Alice101, that IMO will definitely open the door for a hearing before SCOTUS! All IMHO! It will also give SCOTUS reason to laugh out loud, at the behavior of both lower courts! Again, all IMHO!
