The thing with the FDA that’s got people confused is that the farm bill made hemp legal federally but the FDA has not caught up with sending out guidelines in its regulation like they said. The FDA approved Epidiolex which the active ingredient is CBD one of the many cannabinoids in cannabis and hemp. This has made it confusing for companies with hemp cbd infused products since now some states like New York are cracking down on them, staying that they can’t put CBD in their products because as per the FDA, an additive cannot be considered a supplement if it available in a current medication eg Epidiolex has CBD and Dronabinol has THC. I think things will quickly have to be clarified as senators and congressmen are pushing for clarification knowing there is a lot of money to be made. I think all good things for the future of our conglomerate!

Additionally, it’s unlawful under the FD&C Act to introduce food containing added CBD or THC into interstate commerce, or to market CBD or THC products as, or in, dietary supplements, regardless of whether the substances are hemp-derived. This is because both CBD and THC are active ingredients in FDA-approved drugs and were the subject of substantial clinical investigations before they were marketed as foods or dietary supplements. Under the FD&C Act, it’s illegal to introduce drug ingredients like these into the food supply, or to market them as dietary supplements. This is a requirement that we apply across the board to food products that contain substances that are active ingredients in any drug.
