The Uneven Impact of Alice
What do bioinformatics, artificial intelligence, autonomous driving, blockchain and business methods have in common? They are all fundamentally software driven solutions. They have also historically been treated differently by the USPTO depending upon where your application lands.
Despite the great potential for these innovations, such as innovations in the bioinformatic space that promise to identify new drug therapies and provide a greater understanding of complex disease and adaptations and mutations, the Supreme Court’s decision in Alice v. CLS Bank has wreaked havoc on these patent applications. It is also well known that Chinese artificial intelligence startups are receiving more funding that U.S. based AI startups.
The state of patent eligibility is of enormous concern. Senator Chris Coons (D-DE), Senator Thom Tillis (R-NC), Congressman Hank Johnson (D-GA) and Congressman Doug Collins (R-GA) are actively seeking a legislative fix to 35 U.S.C. 101.
