I don't think there would be a different outcome with the 12 judge federal circuit panel. Most if not all of these type of software patent cases are being ruled as abstract ideas. They're just kicking the can down the road by affirming the lower court decisions.
My hope is that SCOTUS takes on and makes a decision on HP INC. v. BERKHEIMER soon since they asked for the brief. It seems SCOTUS is interested in fixing the mess they started with the Alice 101, rule 39 abstract idea BS they started in 2014. Most if not all the news articles I've read concerning Alice 101 are negative saying that it's stifling innovation in software.
If that happens I think we have a good chance in any court.
