I was 60% after the hearing, but since then I have listened to orals a few times and compared them with the briefs. I have discussed this with others more knowledgeable of the process and have become 90% confident we will prevail. Hopefully that is with a precedent decision (less confident because of Dyke), at the least an overturn and remand (90%).
