Yes true but GNBT did trigger the default by not listing on nasdaq within the specified time. Even I know the timing of a nasdaq listing is out of your control and to qualify (price wise) so quickly after a huge forward split is a big long shot at best.
So theres plenty of responsibility GNBT should take for this screw up
