I, as well as, most everyone here, have probably listened to the recording of the hearing with open minds while sitting on the edge of our seats, balancing everything we know and think we know with every word spoken.
I found myself lost, more than a few times, in the rapid firing of facts and information. Each lawyer had rehearsed and rehearsed to get ready for their case to be heard, Unfortunately for them, all of this had to be done in a matter of 15 minutes each.
I listened, I paused, I hit rewind, only to repeat again, and again.
Forgive me, but at first I was concerned that our lawyer was rambling! I was also concerned the questions asked from the judges at one point were being avoided. Where was he going with this??
Coincidentally, the SecureAuth lawyer was also rambling and made some bold statements and seemed to get ahead of himself. The judges repeatedly interrupted him by clarifying statements and at times completely questioning his thoughts!
I soon realized this was the nature of the beast. Speak fast, speak as clearly as possible, while also covering all topics written in their notes that were a must for that day.
After listening through twice the full length of recording a clarifying thought popped in my head. I needed to slow down this whole process for my pea brain to understand and absorb what BOTH sides were saying.
So if you made it this far- My next 3 posts will be the complete transcription of oral arguments put into text by me. SFOR argument, SA argument, and finally SFOR rebuttal. I painstakingly listened and wrote, edited, listened and wrote more.
This, of all things, gave me clarity and understanding as I was able to read, and re-read the transcript.
I decided to post so as to help anyone else who may like to read the arguments with and/or instead of listening. Plus, this adds a quick reference to copy and paste for any future posts and fact checking made.
I have underlined what I thought were some great key items from both sides. A lot of good! A few that made me go Hmmmm...
Overall my opinion is excited, cautiously optimistic-yet mute, because this is truly out of my/our hands. I patiently wait with all of you, while also realizing that our company, Strikeforce Technologies, has been represented by, literally, the best IP law firm in the country, whereas our chief counsel presented a great, well balanced, case.
