I wonder why it wasn’t brought up? That could be a good thing if our attorneys felt or had an indication that the judges would agree without needing to argue the point. Based on hearing the point where a judge said Anapol was wrong, they seem to quickly like to move on or not discuss a point when the truth is already known.
