“Prior to February 2017, Rule 11140(b)(1) provided that if a per-share dividend or other distribution is under 25% of the securities issuer’s share price, the ex-date for the distribution is the second business day preceding the “record” date.1 Pursuant to Rule 11140(b)(2), if the per- share distribution is over 25% or more of the issuer’s share price, the ex-date is the first business day after the “payable” date.”
