If the Appeals Court does 'reverse and remand', I'm wondering exactly what gets reversed. In the narrowest sense, the lower court's ruling was just to dismiss the case because Alice applied (to only one part?), right?. If so, is that all that gets reversed for sure? I hope not, but suspect it is. If so, it would then be left to the lower court to reconsider the case without just kicking it through the Alice looking glass, right? In other words, is it the case that a 'reverse and remand' only favors but doesn't guarantee a good outcome for SFOR?
Have we had any lower court decisions yet from the several reversals on Alice-doesn't-apply basis that you have so nicely tracked for us? If/When we do, we will be on firmer ground with our expectations.
