SFORs future court date scheduling is this:
we were basically behind the last company recently scheduled for Oral date in November. SFOR is up next as far as briefs filed date.
So the expectation is that we would be first up to be scheduled be Dec 20 or 21st for oral date sometime Jan/Feb
Has anything changed? Hello , yes Ropes and Grey's demand of the court via Supplemental Authority that SFORs case has already been decided on the Ancora - HTC decision. It is a Precedent! With R&G compelling the Judges they MUST reserse the case!!
This new evidence has to be submitted before a decision is made so the judges can review this and consider it with the briefs.
Could it be decided by the 21st end of next week? on the briefs , Yes! however will it? we will see.
This supplemental authority is nuclear power, it is filled with is filed when new nuclear evidence that bares on the decision of a case. It blows up Alice 101
Nuclear power as in precedent means the decision has already been made on the case .Would the backlogged court want to schedule something if they already have a precedent case fall into their laps? A case that already has a decision?
If the judges were to read the Supplemental Authority (its 1 page) on the case citing that it represents a precedent for their coming decsion with SFOR - Sec Auth and after reading it and discussing it, and if they agreed that the precedent has already decided the case, couldn't they then decide on the Sup Auth/ precedent and briefs? No need to argue a precedent.
Will it?, we will see.

Doesn't matter if the case is decided on briefs on the 21st , if it is not, there is a consolation prize, for grieving SFOR disappointed shareholders on the same day the 21st they will have a consolation prize, A COURT DATE , however they will have to wait another agonizing whole month , as it will be scheduled jan/feb and we will win on precedent on the court date. Endure my friends!
I for one am glad he posted about the possibility of a 21st decision , he is not the only one who feels that this could happen, there are many in legal circles who feel this could happen.
