These ancient concepts patented & OOBA is not?

These ancient concepts patented & OOBA is not?

Gimli's wheel comparison is an amazing one. What invention is more ancient than that?

You have a stone wheels, potters wheels 3500 years old, then wood were invented or discovered. The axle made the wheel useful for wheel barrows, then chariots.

However look at other simple ancient conceptual items much simpler in concept and known , than OOBA for computers data breach protection:
shoes, bags, knives, forks, spoons , combs, toilet paper , tooth pick, that have been patented.

In Modern times along with Keyboard and Mouse for computers , patents that have shown patentable improvements , invented on previous ideas and designs , improvements in materials, to work more efficient ,are effective with advances with new technology, for example like keyboards in the virtual world over the original idea of a keyboard on your desk. And yet they are all patentable. Built with new invented technology over the original patented Idea. Making a new product.

You would imagine all of the above patents would be shot down by Alice 101 according to Knobbe Martens argument. Any yet they are not!

According to Knobbe Martens legal briefs they claim the idea of OOBA has been around for ages, that the ancient greeks were aware of the concept of OOBA and everyone is aware of it in modern times

Well if that is true, then how can any of the ancient items referenced (below) escape the application of Alice 101? Everyone was aware of those ancient concepts as well!

Wouldn't all the above ancient patented items, be abstract, unpatentable?

Wheels are round, made to turn round and round, a known concept for ages.


However SFORs OOBA , Out of Band Authentication was a technological breakthrough years ahead of its time, showing inventiveness in solving a specific problem , a problem that didn't even exist at the time of concept and design , no one was aware of OOBA at time of idea, no one had even the concept of the idea, there is not even a valid ancient concept equivalent to OOBA requiring a second method of authentication, it was not a known technology at the time, a complete unique line of thought and technology, a revolutionary advancement and breakthrough of data protection over previous widely used username /password authentication method. SFORs patented OOBA immediately became prominently illegally used roughly 10 years after OOBAs invention 10 years before it was needed.

And yet look below at the following ancient concepts with modern patents for example the modern wheel/tires, shoes, bags, knives, forks, spoons , combs, toilet Paper , tooth pick, have all uncontested patents by alice 101 , why?

Because there were significant breakthrough improvements over previous patents in the inventiveness in design, materials over previous patents, and they were granted by the USPTO legal enforceable patents. Not challenged or overturned by alice 101

How can the modern patents (referenced below) from ancient known concepts be patentable and SFORs inventive OOBA computer invention, not known in ancient times, technically unknown at the time of its invention, years before its time in solving future unknown specific problems not be patentable?

In addition, how can SFORs patent be unpatentable when it was challenged recently and the PTAB (Patent Trial Appeal Board ) critically reviewed each of the 53 claims of the patent and came to the conclusion it was a legal patent?

Check out the number of patents from some well known, simple designed ancient concepts. Many of the modern patents were granted by adding new inventions to prior patents, making a new inventive patentable product.
