The Federal Circuit doesn't cower. DECN should immediately file a writ with the Federal Circuit for being denied Due Process. This is outrageous behavior. The effing judge made his ruling based on things attributed to DECN that they did not say in oral arguments or write in pleadings.
Mr. Sensitivity believes that there is near 100% chance of reversal, about 90% chance of rebuke, and about 90% chance of settlement just prior to the mandatory settlement conference. If there is no settlement prior to the mediated settlement conference that is ordered by the court, then Sensi believes that DECN should get their backs up and take their chances.
Time to buy. This is when people should remember that they are in the land of the free and the home of the brave.
