Former Chairman of Rocky Mountain High Brands Files Appeal On Recent Court Ruling
Dallas, TX -- September 16, 2018 -- InvestorsHub NewsWire -- On September 7, 2018, Jerry Grisaffi, former Chairman of Rocky Mountain High Brands, Inc. (OTC: RMHB) filed a notice of appeal with the Court of Appeals, 5th District of Texas at Dallas, from the August 30, 2018 Order issued by the 192nd District Court in and for Dallas County, Texas. The District Court's Order, detailed in the Company's most recent Form 8-K filing and press release, awarded a default judgment against Grisaffi as a sanction for contested discovery failures, striking his answer and separately dismissing a derivative shareholder claim.
Grisaffi said, "This ruling was based on technical disputes about discovery without any bearing on the merits of my claims against the Company. There has yet to be any evidence presented in this matter and I believe it will become clear as this case progresses that the Company's litigation tactics were designed to thwart a presentation of the facts and conceal its bad acts from the Court and its shareholders. The Company's SEC filings speak volumes about mismanagement and self-dealing since I left; eventually these matters will be fully revealed. If this Court doesn't want me to prosecute the derivative claims, I have no doubt some other shareholder will."
The appeal process is expected to take up to six months.
Grisaffi separate malpractice case against his former personal attorney David Seeberger, an officer and director of Rocky Mountain High Brands, continues. He seeks damages in the amount of $1,000,000, but this amount could be increased based on the Company's case. Grisaffi said, "Seeberger did not provide me or the Company with competent, independent legal counsel. The Company is claiming that actions I took in reliance on Mr. Seeberger's advice or opinions somehow injured it; I contest all its claims, but none of this would've come up if he had simply done his job."
