..You file an answer to the complaint for declaratory judgment along with counter-complaint for breach of contract with a jury demand within the time period required by the rules. However, if you do not have a basis to allege that the other party has breached the contract, then you answer the declaratory judgment action and request the relief be denied because there are factual issues in dispute and the case is inappropriate for declaratory judgment. Usually the plaintiff files two counts, one for breach and one for declaratory judgment, in which case you can ask for a jury trial on the breach of contract claim against you. If you're not sure, just request jury trial anyway.
