Dirk, I would say its 50/50 that there will be a within 30 days. If there is no ruling by Judge Boulware, lets say by September 30, DECN can then take a more drastic measure, writing a similar letter to the Head Judge of the Nevada District Court, in effect putting the entire Nevada Federal District on notice. I think that would guarantee a ruling by Thanksgiving -- or it might guarantee a transfer of the case to a recently confirmed judge in that court similar to what happened in the first Lifescan case where the overwhelmed (some would say dimwitted) Judge Davila was able to get the Head Judge in San Francisco to assign the DECN case to a new Judge (Orrick). Of course the Federal Circuit court came down less than 60 days later with a scathing ruling and reversal, reaffirming that I am not the only person who viewed Davila as dimwitted.
If Boulware throws his hands up it would be because the engineering and scientific concepts in the DECN case not only escape him, but also escape all of his clerks. I personally would gain a lot of respect for the guy if he did this. It would point out that he realizes that he is expected to know everything about everything, but he admits that he doesn't. That means that Judge Boulware could never be a message board poster.
Nonetheless Dirk, 50/50 by September 10. All IMO.
