On December 20, 2017, the Court granted Plaintiff StrikeForce Technologies, Inc.’s (“StrikeForce”) and Defendants Gemalto, Inc.’s, Gemalto, NV.’s, and SafeNet, Inc.’s, (collectively, “Gemalto”), and VASCO Data Security, Inc.’s (“VASCO”) (all parties collectively, “the parties”) Joint Motion to Stay case nos. 1:17-cv-10422-RGS and 1:17-cv-10423-RGS until the subject matter patentability issue under 35 U.S.C. § 101 is fully resolved in StrikeForce Technologies, Inc. v. SecureAuth Corp., Case No. LA CV17-04314 JAK (SKx) (C.D. Cal.) (“the SecureAuth litigation”). Gemalto, Dkt. 63; VASCO, Dkt. 59. The Court also ordered the parties to submit a joint status report every 120 days. The parties previously filed a status report on April 19, 2018.
The parties hereby file this joint status report pursuant to the Court’s order regarding the status of the SecureAuth litigation. StrikeForce filed a Notice of Appeal to the U.S. Court of Appeals for the Federal Circuit on January 16, 2018. Briefing in this appeal was completed in June 2018, and StrikeForce and SecureAuth are currently waiting for the Federal Circuit to set a date for oral argument.
Additionally, in June 2018, defendant VASCO Data Security, Inc. changed its name to OneSpan North America, Inc., and its parent corporation, VASCO Data Security International Inc., changed its name to OneSpan Inc. Once the stay is lifted, OneSpan will file a motion to amend the caption of the case.
Pursuant to this Court’s Order (Gemalto, Dkt. 63; VASCO, Dkt. 59), the parties will continue to file a joint status report every 120 days and inform the Court of any final resolution and how the parties intend to proceed within 21 days of any final resolution. Unless there is an earlier final resolution, the parties will file the next joint status report on December 17, 2018.
