But here's the real question in this case. Who is it that stands to benefit the most from a ruling on this Motion? Why didn't J&J complain that the judge was dragging his feet? Could it be that J&J themselves believe that their case is weak and no ruling is a good ruling?
We shall soon (2-3 weeks) see. IMO DECN cannot lose. They either defeat the Motion by virtue of the judge's ruling for DECN, or the judge rules against DECN and they immediately appeal to the Federal Circuit court where they have a perfect 3-0 record against J&J. The Federal Circuit court in Washington, DC takes none of J&J's crap, and the judges in the Federal Circuit tend to crush District Court judges that they think are either dumb or biased. The trial judge in Nevada really does not want this and that's another reason why he hasn't ruled -- yet.
