Just because the Strikeforce v. Duo case is stayed pending info from the federal appeal of a separate case, doesn't IMO mean that they couldn't reach settlement at any time. Is it likely? Probably not, but you never know.
So Cisco offers to buy another company, Duo. Cisco has been a poster child for acquiring companies during their history and they are a huge fish. Sometimes people ignore problems. Cisco could however be discounting their Duo offer due to the unresolved legal battles that Duo has. There's no way IMO that Cisco's legal team couldn't estimate the impact of settling Strikeforce v. Duo. and reflect that in their bid if they wanted to spend the time on that detail. Or perhaps they have an out with a clause that reopens their bid agreement when legal troubles change the financial picture. I would surely expect that clause to be in there.
Perhaps Cisco already has a NDA with Strikeforce and all they need to do is consider the possibility of past damages.
All in all, the Cisco news shows how the value of authentication is increasing fast. JMHO
