The investigational resources in the US are pressed for enough resources, not to mention inadequate prosecutorial staff and totally inadequate resources for public defenders. Actual court prosecutions are by the Justice Department with advisory services from an agency like the FTC. Justice can be capricious about which cases they take, and the Justice Department is constantly seeking volunteer attorneys on detail (loan) from Federal agencies, to serve as Special Assistant US Attorneys. Hence an active agency like FTC or CFTC will strike a bargain with the people/companies being prosecuted.
When we are lucky, we get every penny back. Usually we don't. Especially not if the SEC is involved.
