Yes because the new owner or the company that buys Lifescan from the new owner will continue to sell the infringing products. Don't believe the 2 minute wonders on the other message boards who in the amount of time it takes to pee anoint themselves with an important sounding name and elect themselves experts. Lifescan has sold at least 25 million boxes of OneTouch in each of the last six years. The cost of that will be dear. The cost of the continued use (forward) of the infringing product will be less but nonetheless exorbitant.

They have screwed and attempted to screw companies for decades. So you can bet that Lifescan is involved in many suits that need addressing. You want to know how Mr. Berman will get his hands on a BIGGER part of that set-aside money? File a strike suit in Delaware Federal Court. If he does that Berman can claim that he wants his $400 million to settle up the patent infringement case, but in the spirit of a legitimate owner taking over Lifescan, he will give an early summer discount to settle DECN's claims.
