I would suggest that there is always an opportunity for cases to be settled before a court decision is made. In the end, I think all parties in these cases want to do business and make money. I don't think this court is going to let SecureAuth have much satisfaction.
IMO it may be settled before the judges rule, especially if in the meantime it turns out that ACS gets paid big money in licensing revenues from household names. The infringers can read between the lines too I think and will finally settle to avoid embarrassment as more and more big clients come on board with licensing. Just my opinion.
