I would agree with those who say they can put it on the market without proof, at least in cannabis stores. Once granted, I suspect OWCP will try to enforce their patents and they will either have to pay for the rights to make the products, or take their products off the market.
As I understand the Canadian market, they're delaying the plan to make cannabis available there in July by 3 to 6 months. If that remains the case, this might be resolved before they can put their first product on the shelves. Of course without knowing precisely what's in our patent, and how they're making their tablet, it's impossible to say for certain they're in violation, but given their description of what they're making, it sounds like they're pretty likely to be in violation of our patent.
