ZP great-article on Alice-101s more-difficult for
Post# of 82672
Looks like the burden of evidence got heavier for infringers to prove Alice 101 before a trial for the lower courts and Judges need to allow more information to be discussed prior to trial. To get a feel if the patent should succumb to an Alice 101, is how I read it. The judge need to analyze the strength of the patent.
Looks like District level Judges are even more prepared to correct cases where the law was not followed in adjudicating (judging) these cases. There has to be some discussion to see the strength of the inventiveness of the processes and technology of the time, consider the patent to see if it significantly defeats the Alice 101.
If they don't do that then they haven't followed the law. and it needs to be overturned. My expectations of 99.8% of a dismissal overturn, now after this article jumped up to 99.98 of an overturning in the district federal courts.
lol
Thanks again ZP for another awesome article , appreciate your DD! You are the best!
