Appealed on what basis? We want the supreme court to support a decision that was not made according to guidelines in patent infringement trials? A patent is a legal instrument., goes though a legal process and requires a lot of DD to prove your patent is legit. A judge cannot throw it out with out considering all the evidence. Because he wants to go back to his chambers and lure female staffer to watch porn in his chambers which he was removed as a judge for doing after the case.
So no appeal, just like a frivolous law suit that has no legal basis, no legal leg to stand on. Cant be appealed.
