I'm not absolutely certain about here in the U.S. but I think that even without the safety trial they're running, their are countries where you could sell it today. I believe that OWCP at least intends to prove it's products safe before it permits sales anywhere.
The question in my mind is do they also want them to have demonstrated efficacy. I really don't know the answer to that question, perhaps we'll hear it this week.
Their are all sorts of products on the market that have little or no proof that they do anything. A Phase 2 that was of short duration and small size could probably be completed by the forth quarter of this year for the cream, but I believe their are other possibilities.
What if they marketed the product with a money back guarantee and promised a discount on future purchases to anyone providing a testimonial to the effectiveness of the product with an added bonus for before and after pictures. While sales cannot substitute for a Phase 2 or 3 trial, they can gather sufficient anecdotal evidence to interest those running such trials to try to make them short and sweet.
OWCP has the choice of who will sell it's products, but that decision may be dependent on how they plan to market the product. I would doubt that OWCP would license the rights to sell the product as an approved drug to a company not qualified to do drug sales. If a company was qualified to sell both types of products, that could lead to larger deals.
As I mentioned in an earlier post, I believe OWCP may be waiting for both trial results as well as patent approvals before finalizing marketing agreements. We know they have a producer ready to make commercial quantities of the products, Emilia, but I believe even they would have liability if the product went on the market without proof of safety. We should know the cream is safe sometime this quarter. I expect we'll hear something more at the Wall St. Conf.
