About Meeting Mueller: Any Misstatement
Could Be a Felony < >

President Donald Trump’s legal team wants him to decline to speak directly with Special Counsel Robert Mueller as part of Mueller's investigation into Russia’s attempted meddling in the 2016 election.

In recent weeks, Fox News senior judicial analyst Judge Andrew Napolitano has been emphatic that Trump should avoid a Mueller interview, warning that it could be a "perjury trap" and a "recipe for disaster."

On "Outnumbered Overtime" on Tuesday, Napolitano explained that Mueller and his investigators know exponentially more about the case than Trump does, and Trump has no way of knowing what evidence Mueller may already have.

"It only takes a couple of slip-ups for them to say to his lawyers, 'We caught your client in a lie. Do you want us to present this to a grand jury and see if they indict him?' That would be catastrophic for the president. Don't give them that opportunity," Napolitano said. "Don't help them prosecute you."

He explained that lying to federal investigators is itself a crime, even if prosecutors cannot prove that any other criminal activity occurred.

"A misstatement could be construed as a lie to a federal official in a formal investigation, and that's a felony," Napolitano said.

He said if Trump ultimately rebuffs a request for an interview, Mueller could pursue a subpoena compelling his testimony – setting the stage for a high-stakes legal battle.
