At the latest) SecureAuth will be forced to begin a defendant argument as to why the circuit court of appeals (which is comprised of 3 former patent attorneys...Look it up yourself) not rule in SFOR's favor during this portion of the process and instead make a ruling to sustain the appeal. That's why there are numerous Ropes and Gray AND Blank Rome attorneys now involved. The petitioners Brief by March 26 at the latest will be mind boggling and scathing to the SecureAuth case. Twice now the Federal PTAB has reviewed petitioners claims against Strikeforce' patents and both times the rulings have been in favor of SFOR'S patents. Judge Kronstadt's ruling that SFOR patents are essentially not binding and frivolous (based on Ruling 35/101) without any stated and documented basis in the final ruling is completely without merit. I wonder how 3 former patent attorneys will view the case???
