That is an exceptional case and it involves the government immigration policy (DACA) and i have not been following the case so won't comment on it but not a good apples to apples comparison.
Our case does not involve a government policy so i'll say No and besides just b/c we want the Supreme court (SCOTUS) to hear our case, that isn't a sure thing unlike many on here alluded that notion.
Why?
Let's say after the CAFC, RG does not like the outcome of the appeal so wants to appeal to the SCOTUS, the chance of SCOTUS hearing our case will be less than 2%, that's a fact, don't just believe me and find out for yourselves.
In other words, for most of cases CAFC will be the last stop for appeals.
