I don't know yet how many attorneys from Blank Rome are involved in this as well but this OVERALL TEAM is writing the appeal document now. What has caused me to research this in more depth is how Ropes & Gray responded to the Duo, Trustwave and Centify Patent challenge with their 74 page overwhelming response. The more I research this I'm wondering if the new Judge will even hear the appeal. The ONLY basis for the SecureAuth decision was based on the 101 Jurisprudence. None of the patents were challenged. If the new Judge deems that this lawsuit is NOT frivolous (based on the Microsoft and Entrust settlements), could he himself overturn the decision?
