Evidence as in official FINRA or SEC data, not speculations. Although Mako/Rosen’s short and distort tactic was illegal, they could’ve shorted the stock the legal way. Don’t get me wrong, I’m not defending what they did. I hope they go to jail one day.
The FINRA daily #s are where we have disagreement on what they mean.
As for manipulations, the naked shorts weren’t doing a very job and allowed the stock to go up 50% this week even with 42%, 35%, 53% and 40% of shares shorted.
Cases like Eros and Overstock goes back to my argument that just because there’re thieves in my neighborhood doesn’t mean there’re theives in my house. If Leo is suing naked shorts, he’s going to need hard evidence. He can’t just say IPIX is under attack by naked shorts because the same thing happened to Eros or Overstock.
