10 years is a long time to have capital tied up. And there's been closer points (purportedly - "world's largest retailer" etc) in the past... that, I think, is what *most* of the people expressing genuine skepticism are talking about. Always around the corner but forever out of reach.
My point is nothing in the court is going to alter the capital structure... it's a not insignificant topic that has bearing on every aspect of the company, going forward, regardless of the outcome tomorrow. It could be positive, it could be negative. There's no solid indication which, at the moment (and that won't likely change tomorrow or the day after).
